1. Acceptance of Terms

Welcome to StyleGhost. These Terms of Service ("Terms") govern your access to and use of the StyleGhost platform, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and StyleGhost ("we," "us," or "our"). By creating an account, accessing the platform, or using any features, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Changes to Terms: We reserve the right to modify these Terms at any time. Material changes will be notified via email or in-platform notice at least 30 days before taking effect. Continued use after changes constitutes acceptance.

2. Description of Service

StyleGhost is an AI-powered content creation platform that helps you generate, edit, and publish content across multiple social media platforms. The Service includes:

• AI content generation based on your writing style
• Draft creation from source materials (essays, videos, URLs)
• Content editing and refinement tools
• Scheduling and publishing to third-party platforms (X/Twitter, LinkedIn, Threads)
• Style learning and voice analysis
• Content organization and management

Tool Provider Status: StyleGhost is a tool, not a publisher. You remain solely responsible for all content you create, edit, and publish using the Service. We do not control, verify, or endorse user-generated content.

3. Account Registration and Security

3.1 Eligibility

To use StyleGhost, you must be at least 18 years old or the age of majority in your jurisdiction. By creating an account, you represent and warrant that you meet these age requirements.

3.2 Account Creation

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the accuracy of your account information.

3.3 Account Security

You are responsible for:

• Safeguarding your password and account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

Do not share your account credentials with others. We are not liable for losses resulting from unauthorized use of your account.

3.4 Account Ownership

Your account is personal to you. You may not transfer, sell, or share your account with others. Accounts found to be shared or transferred may be terminated without notice.

4. User Responsibilities and Prohibited Conduct

4.1 Copyright Compliance

You must comply with all applicable copyright laws and regulations. Before using third-party content (essays, articles, videos, images) as source material:

• Ensure you have the legal right to use the material
• Obtain necessary permissions, licenses, or consents from copyright holders
• Respect intellectual property rights and fair use limitations
• Provide proper attribution where required

You are solely liable for copyright infringement claims arising from your use of the Service.

4.2 Consent and Privacy

You must obtain consent before using content created by others. This includes:

• Getting explicit permission from content creators
• Respecting privacy rights and publicity rights
• Following attribution requirements
• Complying with platform-specific content policies

4.3 Prohibited Conduct

You agree NOT to use the Service to:

• Violate laws: Engage in illegal activities or violate any applicable laws or regulations
• Infringe rights: Violate intellectual property, privacy, or other rights of others
• Spam or abuse: Send unsolicited messages, spam, or engage in abusive behavior
• Harmful content: Create content that is defamatory, harassing, threatening, or promotes violence
• Misinformation: Deliberately spread false or misleading information
• Impersonation: Impersonate others or misrepresent your identity
• System interference: Interfere with or disrupt the Service or servers/networks
• Unauthorized access: Attempt to gain unauthorized access to the Service or other user accounts
• Automated abuse: Use bots, scrapers, or automated tools to access the Service without permission
• Reverse engineering: Reverse engineer, decompile, or disassemble the Service

4.4 Platform Compliance

When publishing content to third-party platforms (X/Twitter, LinkedIn, Threads), you must comply with their terms of service, community guidelines, and content policies. Violations of third-party platform rules may result in termination of your StyleGhost account.

4.5 Consequences of Violations

Violations of these Terms may result in:

• Warning or suspension of your account
• Immediate termination without notice
• Removal of content
• Legal action (if applicable)

5. Intellectual Property Rights

5.1 StyleGhost's Intellectual Property

The Service, including its design, features, functionality, software, code, algorithms, and content (excluding user-generated content), is owned by StyleGhost and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works of the Service
• Sell, license, or distribute the Service or its components
• Remove or alter copyright notices or proprietary marks

5.2 Your Content Ownership

You retain ownership of content you create using StyleGhost. You own all intellectual property rights in your original content, drafts, and published materials.

5.3 License Grant to StyleGhost

By using the Service, you grant StyleGhost a non-exclusive, worldwide, royalty-free license to:

• Use your writing style patterns (excluding personal information) to train and improve our AI models
• Store, process, and display your content as necessary to provide the Service
• Create backups and derivative works for operational purposes

This license continues even after account deletion for style data already incorporated into trained models (technical limitation of machine learning systems). See our Privacy Policy for details.

5.4 AI-Generated Content

Content generated by StyleGhost's AI is provided "as is" without guarantees of originality, accuracy, or non-infringement. You are responsible for:

• Reviewing AI-generated content before publishing
• Ensuring AI outputs do not infringe copyrights
• Verifying accuracy and appropriateness of AI suggestions

StyleGhost is not liable for copyright claims arising from AI-generated content.

5.5 Feedback and Suggestions

If you provide feedback, suggestions, or ideas about the Service, you grant StyleGhost an unrestricted, perpetual license to use such feedback for any purpose without compensation or attribution.

6. Service Availability and Modifications

6.1 Service Changes

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service.

6.2 Scheduled Maintenance

We may perform scheduled maintenance that temporarily makes the Service unavailable. We will provide advance notice when possible, but are not obligated to do so for emergency maintenance.

6.3 No Guarantee of Availability

We do not guarantee that the Service will be available at all times or function without errors. The Service is provided "as is" without warranties of uninterrupted access or error-free operation.

7. Limitation of Liability

7.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your requirements or expectations
• The Service will be uninterrupted, secure, or error-free
• AI-generated content will be accurate, original, or appropriate
• Defects or errors will be corrected

7.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STYLEGHOST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not we have been advised of the possibility of such damages.

7.3 Maximum Liability

In no event shall StyleGhost's total liability to you for all claims arising from or related to the Service exceed the amount you paid us (if any) in the 12 months preceding the claim, or $100, whichever is greater.

7.4 Third-Party Platforms

StyleGhost is not responsible for actions, policies, or practices of third-party platforms (X/Twitter, LinkedIn, Threads). Once content is published to third-party platforms, their terms and policies govern. We are not liable for:

• Content removal or account suspension by third-party platforms
• Data breaches or security issues on third-party platforms
• Changes to third-party platform APIs or policies

8. Indemnification

You agree to indemnify, defend, and hold harmless StyleGhost, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights (including copyright, trademark, privacy, or publicity rights)
• Content you create, upload, or publish using the Service
• Copyright infringement claims related to your content
• Your violation of applicable laws or regulations

This indemnification obligation survives termination of these Terms and your use of the Service.

9. Termination

9.1 Termination by You

You may terminate your account at any time by deleting your account in Settings or contacting us at support@styleghost.ai.

9.2 Termination by StyleGhost

We may suspend or terminate your account immediately, without notice or liability, for any reason, including:

• Violation of these Terms
• Suspected fraud or illegal activity
• Repeated copyright infringement (DMCA repeat infringer policy)
• Abuse, harassment, or harmful conduct
• Non-payment (if applicable)

9.3 Effect of Termination

Upon termination:

• Your right to access and use the Service immediately ceases
• We may delete your account data and content (subject to legal retention requirements)
• You remain liable for any obligations incurred before termination
• Sections of these Terms that by nature should survive (indemnification, limitation of liability, dispute resolution) will continue to apply

9.4 Data Export Before Termination

If you plan to delete your account, we recommend exporting your data first using the data export feature in Settings. We are not obligated to provide data after account deletion.

10. Dispute Resolution and Arbitration

10.1 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at support@styleghost.ai to attempt to resolve the dispute informally. We will make good-faith efforts to resolve disputes amicably.

10.2 Governing Law

These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

10.3 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

You agree to waive your right to a jury trial and to participate in a class action lawsuit.

10.4 Exceptions to Arbitration

Either party may bring a lawsuit in court for:

• Intellectual property disputes (copyright, trademark infringement)
• Claims seeking injunctive relief

10.5 EU and UK Users

If you are a consumer in the European Union or United Kingdom, you have the right to bring disputes in your local courts under applicable consumer protection laws.

11. Miscellaneous

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StyleGhost regarding the Service and supersede all prior agreements.

11.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing.

11.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign or transfer these Terms without restriction (e.g., in the event of a merger or acquisition).

11.5 Force Majeure

StyleGhost is not liable for delays or failures in performance resulting from causes beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, internet failures, or government actions.

11.6 Export Control

The Service may be subject to U.S. export control laws and regulations. You agree to comply with all applicable export and import laws and regulations.
